General terms of conditions
1. Applicability and Definitions
1.1 These General Terms and Conditions apply to all agreements concluded by Grand Apartments with its clients.
1.2 Mediation refers to the best-effort obligation of Grand Apartments aimed at establishing a rental agreement for a residential property between the Client and a third party, in exchange for a fee from the Client, as defined in Article 7:425 of the Dutch Civil Code. Grand Apartments will never accept a mediation assignment from both parties for the same property.
1.3 A third party refers to the (prospective) landlord if the Client wishes to rent a property. It refers to the (prospective) tenant if the Client wishes to rent out a property.
1.4 Deviations from these General Terms and Conditions will only be valid if expressly agreed upon in writing by both parties.
1.5 If the Client consists of two or more (legal) entities, they are jointly and severally liable for fulfilling all obligations towards Grand Apartments.
1.6 If any provision of these General Terms and Conditions is deemed invalid, this will not affect the applicability of the remaining provisions.
2. Cooperation of the Client
2.1 Both parties agree not to take any actions that hinder the proper execution of this agreement. The Client must provide all necessary information and cooperate fully with Grand Apartments to ensure the proper execution of the agreement.
2.2 Grand Apartments will not commence its activities until all necessary information has been provided and any agreed (advance) payments have been made by the Client.
3. For Clients Seeking to Rent Residential Property
Scope of Services
3.1 A search assignment involves the best-effort obligation of Grand Apartments to locate suitable rental properties for the Client.
3.2 The services of Grand Apartments may include:
Providing general advice on the local rental market, housing permits, rental protection, rental prices, and more.
Identifying the Client’s housing needs and search profile.
Searching for properties that match the Client’s preferences.
Arranging and accompanying property viewings.
Evaluating viewings with the Client.
Mediation Assignment
3.3 When requested, Grand Apartments will:
Prepare and present the Client’s application to potential landlords.
Negotiate rental terms with potential landlords on behalf of the Client.
Draft and oversee the signing of rental agreements.
Provide an explanation of the rental agreement.
Additional Services
3.4 Grand Apartments may assist with:
Ensuring timely payment of initial rental fees.
Organizing property handovers and inspections.
Advising on utility connections, relocation services, and more.
3.5 Grand Apartments exclusively represents the Client’s interests in these matters.
4. For Clients Renting Out Residential Property
Scope of Services
4.1 Services for landlords may include:
Advising on rental strategies and market conditions.
Inspecting and photographing the property.
Advertising the property on relevant platforms.
Screening potential tenants.
Drafting and overseeing rental agreements.
Managing the property handover process.
Obligations of the Client
4.2 The Client must provide all necessary and accurate information required for executing the agreement.
5. Data Protection
The personal data of Clients will be processed in compliance with applicable data protection laws and solely for the execution of this agreement.
6. Liability
6.1 Grand Apartments will not be held liable for damages resulting from inaccuracies in the Client’s provided information or actions of third parties involved in rental agreements facilitated by Grand Apartments.
6.2 In the event of liability, it is limited to the fee received by Grand Apartments for the relevant agreement.
7.1 Agreements may end upon:
Successful completion of the intended results.
Written termination by either party.
Failure to meet obligations under the agreement.
8.1 These Terms and Conditions are governed by Dutch law.
8.2 Any disputes will be submitted to the competent court in the Netherlands.
